These Terms and Conditions ("Terms") govern your use of the Dalu Digital website (daludigital.co.za) and the digital services provided by Dalu Digital ("we", "us", "our"), a digital agency based in Johannesburg, South Africa.
By using our website, engaging our services, or subscribing to a support plan, you ("you", "the client") agree to be bound by these Terms. If you do not agree, please do not use our services.
Dalu Digital offers custom digital solutions including, but not limited to:
The specific scope, deliverables and timeline for each project are agreed upon before work begins, either verbally, via email, WhatsApp or through a formal project brief.
All project work begins with a discussion of your requirements. We provide a quote or proposal outlining what is included. Work outside the agreed scope may incur additional charges, which we will discuss with you first.
We may retain the right to showcase the project in our portfolio (with your permission) unless you request otherwise.
Unless specifically included in your quote, hosting and domain registration are your responsibility. We are happy to advise on hosting providers and can set up hosting on your behalf, but the hosting account and domain will be registered in your name. You are responsible for ongoing hosting and domain renewal fees.
We aim to deliver projects within the agreed timeframe. Each project includes a reasonable number of revision rounds (typically 2–3) as specified in the quote. Additional revisions beyond the agreed scope may be charged at our hourly rate.
For once-off projects, payment terms are as follows:
We offer monthly support plans for clients who need ongoing website changes, updates and maintenance. Current plans include:

Plan pricing and inclusions may change from time to time. Existing subscribers will be notified in advance of any price changes.
A "change" includes tasks such as updating text or images, adding a new section, fixing a bug, adjusting styling, or similar modifications. Larger requests (such as building an entirely new page or feature) may count as multiple changes or be quoted separately.
We do not offer refunds for partial months. If you cancel mid-month, you retain access to support until the end of your current billing period.
Support plans cover changes to the specific website or digital product originally built by Dalu Digital. They do not cover third-party systems, hosting issues, domain problems, or work on products not built by us.
All online payments are processed securely through PayFast, a South African payment gateway. By making a payment, you also agree to PayFast's terms of service.
We do not store your credit card, debit card or banking details. All payment data is handled directly by PayFast in a PCI-DSS compliant environment.
To access your subscription details or perform account actions (such as cancellation), we require email verification via a one-time code. This protects your account from unauthorised access.
You are responsible for keeping your email account secure. We are not liable for actions taken by someone who gains access to your email.
Your content: you retain full ownership of any text, images, logos, or other content you provide to us for your project.
Our work: upon full payment, all custom code, designs and digital assets we create for your project are transferred to you. You may use, modify and distribute them freely.
Third-party assets: if your project uses stock images, fonts, icons or libraries with their own licences, those licences apply separately. We will inform you of any such dependencies.
Dalu Digital branding: our company name, logo and brand materials remain our property and may not be used without our permission.

Either party may terminate the service relationship:
Upon termination, any outstanding balances remain due. We will provide you with all project files and assets that belong to you.
We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including natural disasters, power outages, internet disruptions, pandemics, civil unrest, or government actions.
If a dispute arises, we prefer to resolve it informally first. Please contact us at info@daludigital.co.za and we will make every reasonable effort to find a solution.
If informal resolution is not possible, the dispute will be governed by the laws of the Republic of South Africa and subject to the jurisdiction of the courts of Gauteng, Johannesburg.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, including the Consumer Protection Act (CPA), the Electronic Communications and Transactions Act (ECTA), and the Protection of Personal Information Act (POPIA).
